Here's some good news you can share with your members.  Thanks to PLF, it's no longer business as usual at the Corps of Engineers.  And, if it wasn't clear to some, a recent District Court in Texas applied Rapanos to a decision in US v. Chevron Pipeline:
 
Good news from the West:  In Texas, if there's no nexus, "…as a matter of law in this circuit, the connection of generally dry channels and creek beds will not suffice to create a 'significant nexus' to a navigable water simply because one feeds into the next during the rare times of actual flow (page 14)."

So sing along with me: "The stars at night, are big and bright, especially if there's no nexus (in Texas)…"

I hope you didn't mind that I injected a little sense of humor from an email regarding this case I received.

Thank you for your email.  For several years, Pacific Legal Foundation has drawn a line in the sand against these extremists environmental organizations and their agenda to undermine private property rights.  Laws like the Endangered Species Act have proven to be an effective tool for groups like the Center for Biological Diversity to become a veritable species listing machine, promoting the listings of critters, exotic plants, and insects, at the expense of human beings and defying common sense.
 
PLF is one of the most effective organizations taking these groups on in the courtroom.  We have devoted significant resources to our ESA project, and a great deal of that work is being done here in the Northwest Center, based in Bellevue.  We are also representing rural King County land owners challenging the CAO.
 
We could use your help.  The most common way for people to hear about the good work of PLF is by word of mouth from others like you who have become familiar with our mission.  If you would, please provide me with your mailing address and I'll be sure to make sure you receive our newletters and can even send you some extras to distribute.  Of course, any financial support would also be welcome--we promise it will be put to good use.

Just scan this home page of the Sierra Club - Cascade Chapter for a minute.
 
The property rights and freedom organizations need to counter all of this green myth that is being thrown out into our society.  Half the people in the country have bought into this and it take more energy and time to reprogram this distorted thinking.
 
Look at their level of indoctrination of the green theme.  It is no wonder we are losing our land, our freedoms and our liberties.
 
They can't even spell phosphates correctly.  They probably have few to none on the local staff that have relevant education in the soft sciences.  Any technical direction is probably coming from the east coast.....just my heavily bias opinion......

If you'd like to get involved in working toward better legislation, please consider joining our Legislative Committee or one of the many other committees that focus on specific topics.

Before the 2006 legislative session began, the Sierra Club Cascade Chapter defined specific legislative goals for the session, based on the Chapter's conservation priorities. These goals are described below.

Water

Clean Water (HB2322): Support cleaner water by passing legislation to remove phosphates from dishwashing detergent. Such phospates and the resulting blue-green algae pollution have harmed water quality in Lake Whatcom, Vancouver Lake, the Spokane River, Hood Canal and many other rivers and streams around the state. In Spokane, reduction of phosphorous has been determined as the single most important step we can take to improve oxygen concentrations in the Spokane River.

Water Conservation: Secure funding in the budget to commission a study to determine the best way to maximize opportunities for using reclaimed water in the greater Spokane area.

Spokane River Cleanup: Secure funding in the budget to start cleaning up the Spokane River.

Environmental Education

Kids and the Outdoors: Commission a study to assess the benefits of outdoor environmental education on students' school performance.

Transportation

Regional Transportation: Reform the regional transportation package to promote more transit and better governance.

Priorities for a Healthy Washington

We are supporting the broader environmental community agenda:

  • Promote energy independence through renewable fuels
  • Clean up Puget Sound
  • Launch electronics waste recycling
  • Protect kids' health by eliminating toxic flame retardants
  • Defend our state's land use protections.

Off Road Vehicles

During this session, off-road-vehicle supporters may introduce legislation that would open more public lands to motorized use. We'll work to defeat or amend these bills, as appropriate.

Build Environmental Majorities

We'll continue our work to build environmental majorities by focusing an appropriate amount of our lobbying and grassroots work on legislators who remain on or close to the fence.
